1. Scope
These Terms and Conditions apply to the use of the website and the purchase of digital services provided by Jan Köhler & Roman Lautner Vibesolutions GbR (“Provider”) for consumers (B2C).

3. Subject Matter
The Provider offers a web-based, location-enabled quiz and scavenger-hunt application. The paid contractual service is the unlock of paid digital content/features.
4. Contract Formation
The presentation of services on the website does not constitute a binding offer. A contract is concluded when the customer successfully completes the payment process and the unlock is confirmed.
5. Prices and Payment Processing
- The unlock price is displayed during checkout.
- Payment processing is carried out via PayPal.
- Unlock entitlement arises only after successful payment confirmation.
- The German small business regime applies; VAT is not shown separately.
6. Delivery of Digital Content
Unlock of digital content is typically provided immediately after successful payment confirmation.
7. Right of Withdrawal for Digital Content
Consumers generally have a statutory right of withdrawal. For digital content, this right may expire early if:
- the consumer expressly agrees that performance begins before the withdrawal period ends, and
- the consumer acknowledges that this consent causes loss of the right of withdrawal.
If these conditions are not met, statutory withdrawal rights remain unaffected.
8. Usage Rules and Minimum Age
- The service is intended for users aged 18 and above.
- Users must use the service in compliance with applicable law.
- Misuse, manipulation, and disruption of service operations are prohibited.
9. Availability and Technical Requirements
The Provider aims for high service availability. However, uninterrupted availability at all times cannot be guaranteed for technical reasons.
10. Liability
Use of the service in public spaces and outdoors is at the user's own risk and under the user's sole responsibility.
The user is solely responsible for paying attention to surroundings, complying with traffic and pathway rules, and avoiding dangerous situations while using the service. This applies in particular while walking, cycling, crossing roads, or otherwise moving while looking at a smartphone.
To the extent permitted by law, the Provider excludes liability for accidents, falls, collisions, injuries, or other damages caused by user inattention, distraction, or failure to observe surroundings.
Any further liability of the Provider is excluded to the extent permitted by law. Mandatory statutory liability remains unaffected.
Quiz questions and content are automatically generated using artificial intelligence (AI). The Provider makes no warranty as to the accuracy, completeness, or currency of the generated content. Liability for incorrect, incomplete, or misleading quiz content is excluded to the extent permitted by law.
11. Intellectual Property Rights
All rights in software, content, and trademarks remain with the Provider or respective rights holders. Any use beyond the agreed contractual purpose requires prior consent.
12. Data Protection
Information on data processing is set out in the Privacy Policy.
13. Final Provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection law provides otherwise.
If individual provisions of these Terms are invalid in whole or in part, the validity of the remaining provisions remains unaffected.
